DOCUMENT TO DEMAND THE OUTLAWING OF COMMUNISM AND BRING CRIMINAL JUSTICE AND COMPENSATION TO THEIR VICTIMS.
WHEREAS: The elimination of communism leads to multi party democracy, which is one of the greatest achievements of political and social thought of all time.
WHEREAS: The elimination of democracy leads to preconceived and systematic violation of all human rights enshrined in the Charter of the Rights of Man, another great achievement of contemporary society.
WHEREAS: The preconceived and systematic violation of human rights inevitably results in the most ruthless repression of opposition and with it, the most unthinkable crimes.
WHEREAS: Communism’s, ideology and practice constitute a real possibility for the establishment of government and bureaucracy as a mechanism of power and totalitarian rule of a minority that is enriched on a majority who are impoverished.
WHEREAS: The failure and the crimes of this system have been accredited as historical evidence and that such failure and crime are the necessary and sufficient conditions to show its arbitrary essence, illegal and criminal.
WHEREAS: The illegal nature of the communist system, now renamed the XXI Century Socialism in some countries, brings with it inevitable implementation and development in conditions of illegality.
WHEREAS: Such illegal conditions are created mainly by the formal and official elimination of free association, free opposition, free press, free enterprise, freedom of speech, fundamental pillars of contemporary development, and the elimination of the division and independence of powers, and the establishment of dictatorships that end up becoming fierce tyranny ad infinitum as immutable status quo, that sees the treatment of the human person and society as a whole only in a humiliating way, inhuman and degrading in flagrant contradiction with the Universal Charter of Rights of Man adopted by the United Nations.
WHEREAS: Many of the crimes of the communist system, especially against humanity, are observed, demonstrated and tested and add the tragic figure of more than 100 million victims, not to mention the deaths and victims that have not been yet discover, nor those who may be so in this moment in countries where this macabre system prevails.
WHEREAS: Communism does not comply with modern legal and moral standard whatsoever, and can come to power through armed revolution, violent overtaking of the government, also called the coup, and even using democratic elections.
WHEREAS: The essence and purpose of communism, both yesterday, today and tomorrow, are still the same to continue relying on the same ideology, establishing the same end totalitarianism and producing the same misery and victims wherever applicable.
PROPOSAL:
FIRST: That "Communism" be declared an illegal scheme with that name, or with that mask, as is now "XXI Century Socialism."
SECOND: That it is a crime to propagandize, defend, justify or extol the communist ideology and the communist system and, therefore, the associated with groups, associations, communist parties and communist formations of any kind.
THIRD: That all victims of communism anywhere in the world must be vindicated and compensated, the latter where appropriate, after it had finished in the country concerned, communist totalitarianism.
FOURTH: That a democratic government that exists in any country, regardless of whether communism existed there or not has a moral obligation, social and political of recognizing communism as one of the great atrocities of world history and one of the major aberrations Political Thought, and as such is the moral duty to condemn it and consider it immoral, as well as those who professed or profess.
FIFTH: That a reviewing Board should be established for the Crimes of Communism in the competent international institution, which will bring to justice those criminals and the crimes of communism.
SIXTH: That every country in the world has an obligation to allow the all extraditing of communist criminals, while every country in the world has a right to deport to their country of origin, or where the reviewing Board decides, all communist criminals.
SEVENTH: That any governmental or non-government and citizen or victim of communism, or group of citizens of any country in the world, is entitled to present to the reviewing Board charges against any totalitarian communist tyranny (Communist government) and against any criminal or group of criminals regardless of country of origin of those criminals.
EIGHTH: That this reviewing Board for the Crimes of Communism should establish penalties that are imposed on those responsible for crimes and their accomplices during communism and which range from disqualification to hold public office over a period of years, according to his official duties or unofficial and the severity of his complicity, to imprisonment.
NINTH: That those responsible for crimes committed by the communist system in any country in the world and at any time should under the reviewing Board trials in the room to the Crimes of Communism with all the guarantees of democracy that communism deny its victims.
TENTH: Crimes against humanity committed by any communist system or the perpetrators of such crimes in the past and the present will not expired so to say, and therefore, in all cases those responsible must be brought to justice.
ELEVENTH: That all who by their privileges and perks for cooperating with the communist system have been enriched and kept their wealth in their country of origin or any other country, will be deprived of them.
TWELFTH: An International Anticommunist Constitutional Tribunal should be established which will have as a mission to monitor the development of the rule of law in every country in the world. To detect any order or any legal instrument issued by a president or any official or government institution of the country in question, which can in any way lead the country to dictatorship, totalitarian regime, communist tyranny; to warn the offender and simultaneously report to the united nations organization and all organization for the defense of human rights. Which will hence declare illegal and unconstitutional the order or legal instrument. Disable said order or legal instrument; and is such a case where the offender fails to comply, the offender shall be condemned by said organizations, and if necessary before the reviewing board for the crimes of communism.
THIRTEENTH: It must be noted that there is a Communist Holocaust and establish a date to remember the victims and prevent further.
FOURTEENTH: An International Anticommunism Convention will be the venue, for which a date and place will be announced in due time.
FINAL DISPOSITION:
The highest Institutions of International Law, starting with the United Nations Organization and the The Hague International Tribunal, shall make modifications and adjustments needed to be fulfilled quickly and efficiently, the measures outlined in this document and with supranational character and avoid contradictions in the law between the Order of National Law and International Law.

DOCUMENTO PARA EXIGIR LA ILEGALIZACIÓN DEL COMUNISMO, JUSTICIA PARA SUS CRIMINALES Y REPARACIÓN PARA SUS VÍCTIMAS
CONSIDERANDO: Que el comunismo es un sistema político fundamentado en la ideología marxista-leninista que tiene como base la eliminación de todos los partidos de oposición y el establecimiento del unipartidismo totalitario.
CONSIDERANDO: Que la eliminación del pluripartidismo conlleva a la eliminación de la democracia, que es uno de los más grandes logros del pensamiento político y social de todos los tiempos.
CONSIDERANDO: Que la eliminación de la Democracia conduce a la violación preconcebida y sistémica de todos los Derechos Humanos refrendados en la Carta Universal de los Derechos del Hombre, otro de los grandes logros de la sociedad contemporánea.
CONSIDERANDO: Que la violación preconcebida y sistémica de los Derechos Humanos trae como consecuencia inevitable la más despiadada represión de la oposición y, con ella, los más inconcebibles crímenes.
CONSIDERANDO: Que el Comunismo, su ideología y su práctica constituyen la posibilidad real para el establecimiento del gobierno y la burocracia, como mecanismo de poder y dominio totalitario, de una minoría que se enriquece sobre la mayoría que se empobrece.
CONSIDERANDO: Que el fracaso y los crímenes de este sistema han sido acreditados de forma evidentemente histórica y que dichos fracaso y crímenes constituyen las condiciones suficientes y necesarias para demostrar su esencia arbitraria, ilegal y criminal.
CONSIDERANDO: Que la esencia ilegal del sistema comunista, hoy rebautizado como Socialismo del Siglo XXI en algunos países, trae, como consecuencia inevitable su aplicación y desarrollo en condiciones de ilegalidad.
CONSIDERANDO: Que estas condiciones de ilegalidad están dadas, fundamentalmente, por la eliminación formal y oficial de la asociación libre, de la oposición libre, de la prensa libre, de la empresa libre, pilares fundamentales del desarrollo contemporáneo, y la eliminación de la división e independencia de poderes y el establecimiento de dictaduras que terminan convirtiéndose en feroces tiranías ad infinitum como statu quo inamovible que concibe el trato a la persona humana y a toda la sociedad sólo de forma humillante, inhumana y degradante en flagrante contradicción con la Carta Universal de los Derechos del Hombre aprobada por las Naciones Unidas.
CONSIDERANDO: Que gran parte de los crímenes del sistema comunista, especialmente los de lesa humanidad, están constatados, contrastados y probados y suman la trágica cifra de más de 100 millones de víctimas, sin contar las que no se han podido descubrir, ni las que puedan estar siéndolo en estos instantes en los países donde este macabro sistema impera.
CONSIDERANDO: Que el comunismo no respeta norma moderna legal y moral alguna y puede llegar al poder mediante la llamada revolución armada, el golpe de estado y hasta valiéndose de elecciones democráticas.
CONSIDERANDO: Que la esencia y los propósitos del comunismo, tanto ayer, hoy, como mañana, siguen siendo los mismos al continuar basándose en la misma ideología, estableciendo el mismo totalitarismo final y produciendo las mismas miseria y víctimas donde quiera que se aplica.
PROPONEMOS:
PRIMERO: Que el “Comunismo” sea declarado un sistema ilegal, con este nombre, o con el que se enmascare, como es ahora “Socialismo del Siglo XXI”.
SEGUNDO: Que es un delito propagandizar, defender, justificar o enaltecer la ideología comunista y el sistema comunista y, por tanto, asociarse a grupos, asociaciones, partidos comunistas o formaciones comunistas de cualquier tipo.
TERCERO: Que todas las víctimas del comunismo en cualquier país del mundo deben ser reivindicadas e indemnizadas, donde esto último proceda, una vez que haya terminado en el país en cuestión el totalitarismo comunista.
CUARTO: Que todo gobierno democrático que exista en un país donde ha existido o no el comunismo está en la obligación moral, social y política de reconocer el comunismo como una de las grandes barbaries de la Historia Universal y como una de las grandes aberraciones del Pensamiento Político y como tal está en el deber moral de condenarlo y considerarlo amoral, así como a quienes lo profesaron o lo profesan.
QUINTO: Que debe crearse la Sala para los Crímenes del Comunismo en la institución internacional competente en la cual se juzguen sistemáticamente a los criminales comunistas y a los crímenes del comunismo.
SEXTO: Que todo país del mundo tiene en la obligación de permitir la extraditación de todo criminal comunista, a la vez que todo país del mundo tiene la obligación de deportar, a su país de origen, o a donde decida la Sala para los Crímenes del Comunismo, a todo criminal comunista.
SÉPTIMO: Que toda institución gubernamental o no gubernamental y todo ciudadano víctima o no del comunismo, o grupo de ciudadanos, de cualquier país del mundo, tiene derecho a presentar ante dicha Sala acusaciones contra toda tiranía totalitaria comunista (Gobierno Comunista) y contra cualquier criminal o grupo de criminales comunistas sin importar el país de origen de dichos criminales.
OPTAVO: Que dicha Sala para los Crímenes del Comunismo debe establecer las penas que se les impondrán a los responsables de crímenes y sus cómplices durante el comunismo y que pueden ir desde inhabilitación para ocupar cargos públicos durante determinado período de años, según su responsabilidad oficial o no oficial y la gravedad de su complicidad, hasta penas de prisión.
NOVENO: Que los responsables de crímenes cometidos por el sistema comunista en cualquier país del mundo y en cualquier época deben ser sometidos a juicios en la Sala para los Crímenes del Comunismo con todas las garantías que ofrece la democracia y niega el comunismo a sus víctimas.
DÉCIMO: Que los crímenes de lesa humanidad cometidos por cualquier sistema comunista o por los responsables de dichos crímenes en el pasado y el presente no prescriben y, por tanto, en todos los casos sus responsables deben comparecer ante la Justicia.
DÉCIMO PRIMERO: Que todos aquellos que mediante sus privilegios y prebendas durante el sistema comunista se hayan enriquecido y mantengan su riqueza en su país de origen o en un tercero serán desposeídos de ellas.
DÉCIMO SEGUNDO: Que debe crearse el Tribunal Constitucional Internacional Anticomunista que tendrá la obligación de monitoriar el desarrollo del Estado de Derecho en cada país del mundo, detectar toda orden o instrumento jurídico de cualquier tipo dada por el Presidente o cualquier funcionario o Institución Gubernamental del país en cuestión que pueda encaminar a cualquier país a la dictadura o la tiranía totalitaria comunista, advertir al infractor, denunciarlo simultáneamente ante la Organización de Naciones Unidas y todas las Organizaciones de Defensa de los Derechos Humanos, así como de Juristas de todo el mundo, las cuales, en consecuencia, deben declarar ilegal y anticonstitucional dicha órden o instrumento jurídico, inhabilitar dicha orden o instrumento jurídico y, en caso de que el infractor no responda a la mencionada advertencia erradicando la violación señalada, condenarlo en las Naciones Unidas y todas las organizaciones mencionadas y, si fuera necesario, ante la Sala para los Crímenes del Comunismo.
DÉCIMO TERCERO: Que debe declararse que existe un Holocausto Comunista y establecerse una fecha para rememorar a las víctimas y evitar que continúe.
DÉCIMO CUARTO: Que se convocará a una Convención Internacional Anticomunista cuyo lugar y cuya fecha se darán a conocer oportunamente.
DISPOSICIÓN FINAL:
Las más Altas Intituciones del Derecho Internacional, empezando por las de la Organización de las Naciones Unidas y el Tribunal Internacional de la Haya, deberán realizar las modificaciones y los ajustes necesarios para que puedan cumplirse, rápida y eficazmente, las medidas señaladas en este Documento y que tengan carácter Supranacional y evitar que se produzcan contradicciones en el Orden del Derecho entre el Derecho Nacional y el Derecho Internacional.
